These Terms, together with those incorporated herein or referred to herein constitute the entire agreement between us relating to the subject matter hereof, and supersede any prior understandings or agreements (whether oral or written) regarding the subject matter.

1. ACCEPTANCE OF TERMS AND CONDITIONS
We provide all services to you on the basis of acceptance of these terms and conditions. We may update these terms and conditions from time to time without prior notification to you. The current terms and conditions (which anyone using our services will always be bound to) can always be found at www.makeaportfolio.com/terms.php.

2. AVAILABLE SERVICES
Make A Portfolio provides services relating but not limited to website creation and website and email hosting. This service is provided to paying customers for a fixed fee every month. We may change, discontinue or suspend any or all of the services that we provide or any related content at any time, for any reason, including the functionality or availability of any component at our sole discretion. Limits may also be imposed on any or all of our services (or components of those services) and your access may be restricted without notice or liability. We may also include commercial content or adverts within our products, including those which have been created by users, unless otherwise stated.

3. YOUR OBLIGATIONS
By using the services provided you commit to only add content for which you have full copyright ownership, or permission from the copyright owner. You agree not to use any of our services for illegal or SPAM purposes. In the event your account is found to be being used for SPAM or for any illegal purpose then your account will be discontinued immediately and no refund will be provided.

You agree that you will not modify, copy, distribute, reproduce, license, create derivative works from, transfer, or sell any information, software, products or services obtained from this Web site. You also agree that we retain full copyright ownership of all services provided by us and that by using our services you are being granted a non exclusive, non transferable and terminable license to use that service.

4. TERMINATION / CANCELLATION
You can cancel your paid membership at any time from within your Google account (who handles our subscriptions). Just login then navigate to your Make A Portfolio order and click the 'Cancel Order' option. This will automatically cancel your account at the end of the most recent billing period and your domain will be removed. No refunds will be given.

Make A Portfolio also retains the right to terminate your contract at any time as a result of a breach of these terms and conditions or for any other reason. In the event this happens you will be notified and your account will either be closed at the end of your current billing cycle (and you will not be charged any more money and no refund will be given) or it will be terminated immediately. If terminated immediately then you will be refunded the equivalent amount that you have paid for but not received (eg if you are paying £20/month and your account is terminated half way through the month then you will be refunded £10). You will only be refunded if your account is terminated for reasons other than illegal use, use of the system for SPAM purposes or violation of our terms and conditions.

5. INDEMNIFICATION
You agree to indemnify us against any third party claim or associated costs that arise from: copyright infringement by you, your use of our services for illegal purposes, your use of our services for SPAM or your violation of these terms and conditions. In the event of any of these you agree to accept full liability and pay all associated costs (including but not limited to any fines, charges and associated legal fees).

6. LIMITATION OF LIABILITY
By using this service you agree that we accept no liability for any costs (financial or otherwise) that may arise as a result of using this service, in the event of the services being unavailable, the costs incurred in transferring data to makeaportfolio.com, any loss of data that may happen for any reason or any other event that may occur. You accept full liability for any costs that may arise for the aforementioned reasons or any other reason as a result or related to using any or all of our services.

7. PRIVACY POLICY
The personal information you provide through makeaportfolio.com will be held by us in accordance with the Data Protection Act 1998. The information you provide is held securely on our database and is used to improve the services to our web site users and to notify users of improvements/alterations/notifications relating to the services we provide (or their associated products). Your personal details will not be disclosed outside our company without your agreement. Information provided by you will be disclosed only in an aggregated form to our associates and at no time will any reader be identified individually. The only deviation from this occurs if we are required to share information as part of a legal process.

Whilst we take great care in our security measures to ensure that your data is well protected and are continually monitoring and upgrading it to ensure the most secure service we cannot not guarantee that any such information will not be misused or disclosed to third parties. As a result we accept no liability in this event.
